Chinese Traditional Political Culture That Blocks the Process of Ruling With Law

十五大报告明确了依法治国的目标和任务,从而将我国的法制建设提到了前所未有的高度。从依法治国的历史角度出发,并在与西方法制现状及政治文化思想传统相比较的基础上,我们更容易看出中国现在依法治国症结的本质所在。文章试图分析中国传统政治文化思想中与现代法治相悖的几种因素,以凸现文化传统历史继承性角度上依法治国的困因。

The 15^th Committee report clarifies the goal of ruling with law, which promotes Chinese law making development. From the historical view in terms of ruling with law, along with the comparison between western legal system and political culture tradition, it is easier to see the nature of Chinese problem. The paper tries to reveal the reasons fro the difficulties of ruling with law by analyzing the contradictions between Chinese traditional political culture and modern legal system.
