从国内外图书馆长期的立法实践来看,掌握立法时机的模式有两种,一种是先立法创设制度,后在实践中予以贯彻;另一种是在实践中形成制度,在立法中予以总结完善,一味强调立法条件成熟后再立法是站不住脚的。我国图书馆立法更倾向于后一种模式,即对现成的图书馆法规条例进行总结将其上升为法律制度。

This article elaborated, looking from the practices of the domestic and foreign libraries longterm legislation , there are two kinds of pattern of the legislation Opportunity to be grasped. One kind is first legislates the establishment system, and to implement it in the praetice, Another kind is forms the system in the practice, gives it in the legislation and to be summarized and consummated. Constantly emphasized the ripe of legislation conditions is untenable. Our country library legislation favors the latter kind of pattern, namely tames on the summary, to the ready made library laws and regulations rule and rise them for the legal system.
