我国旅游景区管理法制状况述评

旅游景区管理中的法律问题专题研究在我国几乎是空白,在旅游业蓬勃发展的今天,深入开展旅游景区管理中的法律问题专题研究具有极其重要的理论和现实意义。本文在考察我国旅游景区立法和执法现状的基础上,对我国旅游景区管理方面的法制状况进行了梳理与分析,认为我国旅游景区管理法制状况的主要特点:一是规范的内容由计划经济向市场经济转轨,旅游景区管理法律位阶有所提升;二是地方旅游景区管理法制建设进展惊人。但与国外相关立法相比仍存在诸多不足:一是由于我国规范整个旅游业的旅游基本法的缺位,我国旅游景区管理法制的发展缺乏明确的导向;二是有关旅游景区管理的一些高位阶的、重要的法律规范缺位,相关纠纷的解决缺乏依据;三是对平等关系主体之间的法律关系的规范严重不足;四是地方立法与国家立法之间存在着严重不平衡现象;五是现有的法规和部门规章在立法技术上漏洞较大。

The research on the legal issues of the tourist attraction administration in China is a blank field that should be filled, With the development of tourist industry, it has become more and mere important, not only from the view of theory, but reality, to carry further study and research on the field. On the basis of looking back into the legislation and practice of tourist attractiom in China, this article analyzes the current legislative situation to make the conclusion that there are several characteristics about the related legislatiom as the followings： first, the contents of the legislation is changing from the planned economy pattern to the market economy pattern, which leads to the upgrading of the related legislation. Second, there has been tremendous development on the concerned local legisla tion, While compared with the legislations abroad, ours still have lots of shorteomings of which the reasons lies in facts that： 1, the further development of the related legal construction lacks guidance ~md directiom since we have no fundamental tourist legislation till now; 2. we still have no senior regulations and laws governing tourist attraction administrations so that it is difficult to find a basis to go by when handling concerned cases; 3. we lack regulations dealing with civil relations; 4. there are unbalance between the related local legislations and central ones; 5. there are many flaws in the legislation skill.
