论中国非物质文化遗产的国际法保护

International Law Protection of Intangible Heritage of China

人类文化遗产分为物质文化遗产和非物质文化遗产。文章论述了国际法上对非物质文化遗产保护观念的形成,之后分别通过国际环境法、国际人权法、国际知识产权领域对非物质文化遗产保护方面的重要问题进行了论证,同时着重关注我国的非物质文化遗产的保护问题。

The eultural heritage is classified into the tangible heritage and the intangible heritage. This dissertation at first discussed on the formation of the idea that the intangible heritage should be protected. Then, some important issues are treated in the field of international environment law, the international human right law and the international intellectual property law, laying stress upon the protection situation in China on the basis of international legislation.
