摘要
在德国,按法律规定,买卖合同必须公证。要把这样的德语合同准确无误地译成汉语不是一件容易事,因为它不再是简单的语言问题,更涉及到德国法律。如果译者对德国法律一无所知,对英语一无所知,对国际贸易无基础性知识,要翻译与此相关的德语合同,就更困难了。本文从德语合同翻译中的缩略语与法律用语、翻译德语公证合同时必须吃透原文和德语公证合同的翻译与译者的素质三个方面来讨论这问题。
According to the German law every buying and selling contract must be notarized. To translate a German contract of this kind into Chinese correctly is not an easy job at all. This is because the translation of this kind of contract involves not only language aspects but also German laws. if the translator knows nothing about German laws or English and international trade, it is far more difficult for him to achieve accuracy in translating such contract into Chinese. This paper discusses problems in contractual translation by looking at the questions from the perspectives of abbreviations and law terms, of the correct understanding of the original meaning of words used in contract, and of the relationship between the translation of notarized German contract and the qualification of the translator.
