代建制的几点法律问题思考

Reflection on Law Problem of Fiduciary Duty Institution

代建制作为政府投资工程项目管理的一种方式,已成为我国投资体制改革的热点话题之一。为此,本文辩明了代建制的法律特征,着力对与代建制有关的几个重要的法律问题进行分析,在分析了代建制与工程项目管理和工程总承包的异同、代建制中当事人之间的法律关系以及代建制中的风险防范之后,对代建制立法提出了几点建议。

Fiduciary duty institution is one of main reforms in construction management system in China. In this paper, the author had drawn some relative conclusions through analysis on the legal character of fiduciary duty institution. Similarities and dissimilarities among fiduciary duty institution, engineering project management and total engineering project contract, dissimilarities of emphasis among civil legal relation in fiduciary duty institution, duty contract based on commission relation in contract content and the risk prevention of agent construction system are analyzed. So that it will provide some suggestions on legislation and judicature.
