摘要
立功制度是我国刑法明文规定的刑罚裁量制度。本文以我国现行的刑法规范为依据,在论述我国刑法中立功的种类及其成立条件的基础上,重点探讨了我国刑法中立功制度存在的缺陷及其立法完善建议,以期对我国的刑法立法工作有所裨益。
The meritorious performance is a kind of penal discretion system provided definitely in the criminal law of China. Combining with the current criminal regulations, the article states the categories and constitution of our criminal meritorious performance system and thereby points out the legislative defects of the system. At last it offers suggestions for improving the legislation accordingly in order to make possible contributions to the related criminal legislation of our nation.
