儿童被害人保护初探

Research on Child Victim Protection

儿童成为刑事被害人现象的突出,使得儿童被害人保护变得迫切。儿童本身的特殊生理特征和其在案件中的惟一性、亲历性,是儿童被害人保护的必要性所在。尽管刑事被害人保护已有一般性原则,但针对儿童的特殊性,还应有一系列独有原则,体现对儿童被害人的特别保护。为落实儿童被害人保护,有必要在刑事司法过程中针对儿童的情况设置综合救治制度以及特殊的保护措施。

It is urgent to protect child victim because of the conspicuous phenomena of children becoming criminal victims. It is necessary to protect children victims because of their special physical traits and their sole and direct roles in criminal process. There are some general principles of victim protection, yet we should set up some other principles to give special protection to children victims. And it is also necessary to set up a series of systems and procedures according to the conditions of children, such as comprehensive saving and treating system, protection system, and so on.
