Legislative Suggestions on Prevention From Expansion of Judicial Interpretation in China

最高人民法院和最高人民检察院(以下简称“两高”)的司法解释权是全国人大授予的,但由于全国人大授权不明,导致常常为了自己的利益而越权解释或滥用解释权或使解释范围扩大等,从而严重损害了全国人大的权威,为此,作者认为应当取消“两高”的司法解释权,通过完善全国人大制度和确立判例的约束力等方式来加强全国人大的立法解释和司法解释功能。

The Supreme Court and the Supreme Law - office （2 Supremes for short in the following texts） receive their power of judicial interpretation from the National People＇s Congress （NPC）. Owing to the ambiguity of the empowennent, however, 2 Supremes frequently exceed their authorities and abuse or expand their power of judicial interpretation, which have badly injured the supreme authoritiveness of NPC. For the reasons above, the author believes that we should abolish the power of judicial interpretation of 2 Supremes, and reinforce the legislative and judicial interpretation functions of NPC by improving the National People＇s Congress System and establishing the sanction of legal precedence.
