摘要
我国《劳动法》调整范围以外的雇佣关系与劳动关系应是同质的社会关系,雇佣关系为劳动关系的特殊形态。现阶段司法实践对两者的调整分别适用民法和《劳动法》的做法,只能是在雇佣关系目前尚未由专项法律予以明确规范情况下的暂时性应急措施,今后应建立由《劳动法》对雇佣关系与劳动关系的统一调整模式。
