培育农民现代法律意识与中国农村小康社会建设

Developing Farmers' Modern Law Awareness and Building a Well-off Society in China's Rural Community

培育农民现代法律意识对中国农村全面小康建设中的立法工作、法律实施及经济建设等颇具战略意义,但农民法律意识现状却不容乐观。法外行政、普法畸形、执法粗暴、司法腐败以及农民自身畏法厌诉心理等是制约中国农民现代法律意识培育的重要因素。发展农村经济、完善制约机制、注重风俗习惯、加强农村立法等是培育农民“法律至上”意识的根本路径。

Developing famers＇ modern law awareness is of strategic significance in legislative work, law enforcement and economic development in building a well-off society in an ell-round way in China＇ s rural community, however, the present condition of farmers＇ law awareness allows of no optimism.The important factors of restricting Chinese farmers in developing modern taw awareness are administration beyong law, lopsided popularizing law, enforcing the law crudely, corruption of judicature and farmers themselves fearing and loathing judicial proceedings, etc.. To develop rural economy, improve mechanisms of check and supervision, attach importanee to customs and habits, and enhance rural legislation-this is the basic way to develop farmers＇ awareness of＇putting the law above everything else＂.
