党员义务本位论:党员义务与权利关系的文本解读

On Standard of Party Members' Obligations:Textual Analysis of the Relationship between Party Members' Obligations and Rights

党章文本中关于党员及预备党员的义务与权利、开除党员、自行脱党、党员退党、入党介绍人职责的规定等体现着党员义务本位的价值理念,即党员义务一律一样,党员义务是目的、党员权利是手段,可以作出党员应当履行义务的推定,但党员义务本位并不是党员唯义务论等。党员义务本位与公民权利本位之间是相互统一的,并体现了中国共产党的先进性。

The article takes the standard of the civil rights as the reference frame, and thinks these below embody the value concept of the Party members＇ obligations in the Party constitution text, which includes the formulations about the obligations and rights of Party members, the probationary members of the Party, the dismissal of the Party members, their separation from the Party voluntarily, and their withdrawal from the Party. That is to say, the obligations of Party members are the same and their purpose while their rights are the means, so we can conclude that the Party members should fulfill their duty. But the standard of obligations of the Party members doesn＇ t mean that they only have the obligations but no rights. It＇ s consistent with the standard of the civil rights and reflects the advancement of the Communist Party of China.
