摘要
秘密侦查是我国侦查实践中一种功效卓著的特殊侦查手段,但由于人们认识上的误区,始终没有赋予这种手段以公正合理的地位。文章拟从学理依据及法治化前提的角度探讨秘密侦查措施存在的正当、合法性的基础。
Secret detection is a special detective method with remarkable effect in our detection practice. While ,because of people＇s cognitive error,this method has not been entitled to a fair and reasonable status all along. Therefore, this article attempts to probe into the rationality and legitimacy basis of secret detection measures on the grounds of academic basis and the premise of governmentby law.
