法经济学视野里的法定刑量确定

Determination of Punishment Quantity in the Light of Law Economics

法经济学作为经济学的一门新兴分支,它在刑罚问题研究上给人新的思路,但是由于其中一些关键性的问题有待于更深一步研究,使之对刑罚研究更加系统化、科学化和适用化。回顾了基于法经济学的刑量确定方法,并结合法经济学理论的薄弱环节对这些方法进行了评论,最后对基于法经济学的刑量确定方法研究提出了一些初步建议。

As a new branch of economics, Law economics gives us a new thought in the field of punishment. But some crucial issues wait for research. This article reviews determination method of punishment quantity based on the law economics, and put forward some preliminary proposals on the method research of punishment quantity determination.
