论隐私权与新闻自由冲突的调解

The Intermediation to the Conflict between Right of Privacy and Freedom of the Press

新闻自由与隐私权在塑造完整的人格权方面具有某些相同的功能,然而在实践中二者更多地表现为冲突的一面。新闻自由与隐私权冲突有社会的原因、立法方面的原因、新闻自由和隐私权在本质性质上存有对抗性原因。新闻自由与隐私权冲突的本质是利益冲突和价值冲突,因此,应运用权利制约机制来调解它们的冲突。

The freedom of press and the right of privacy have some similar functions in constructing integral personal right, but in practice, they show the side of conflict more. This article mainly discusses the reason of the conflict between the freedom of the press and the right of privacy and brings forward a feasibility project to solving this conflict, which based on the essence analyse of the conflict.
