摘要
网络链接是互联网上普遍存在的现象,但因链接行为引发的著作权侵权之诉也日益增多。通过对链接行为与著作权人相关权利的分析可知,链接并不一定侵犯了著作权,应加以区分。为规避网络链接侵权问题,提出了相关的救济与保护措施。
The network link is a ubiquitous phenomenon on the Intemet, however the copyright infringement lawsuits caused by the network hnking behavior are daily increasing. By analyzing the relationship between the hnking behavior and the related rights of the copyright owners, we know that linking behaviors will not always infringe the copyright and we should make a differentiation. In order to avoid copyright infringement caused by network link, this essay puts forward some related relieving and protective measures.
