在民法视野中,对不可抗力与意外事件的研究较少,但由此引发的纠纷却大量存在,以致司法实践中经常将二者混淆,对其作为法定免责事由的认识也难以统一。为正确实现二者在法律中不同的免责功能,在廓清其概念的基础上,就二者的区别及各自在民法中的免责效力试作阐述。

In civil law the study of force majeure and accidents is fewer, but there are a lot of disputes on them. There are a lot of confusion in Judicial practice. For the realization of the both different functional in right, on the basis of its conception this paper describes two different effectiveness in the civil field.
