摘要
刑事自由裁量权能够克服刑法局限性,但同时此种权力也有一定的负价值,这种负价值主要体现在此权力容易造成司法随意性和司法腐败。为了克服刑事自由裁量权的负面价值,必须对其进行静态控制和动态控制。其中静态控制包括完善刑事立法,完善刑事司法解释,加强刑事判例编纂。动态控制包括完善对刑事自由裁量权的司法审查,强化判决理由,强化媒体监督。最后但并非最不重要的因素是司法官员的个人素质。
Judicial discretion of criminal law can overcome the limitations of criminal law, however, this kind of fight also has negative value. It will cause judicial random and corruption. In order to overcome the negative value of judicial discretions of criminal law, we must control it statically and dynamically. Statical control includes, making the criminal legislation perfect, improving the judicial interpretation and strengthening the codification of criminal precedents. Dynamical control includes： making the judicial investigation of the fight of discretion of criminal law perfect, strengthening the reason of judgment and the supervision of media. The last but not the least important aspect is the personal quality of judicial officers.
