行政听证:现实操作对制度价值的游离及其回归

随着我国政治体制改革的进一步深化,对行政民主化、科学化的要求越来越高。听证制度作为现代行政程序法的核心制度,在保障政府决策的公正和透明,保障广大公众的切身利益方面,发挥了不可替代的作用,但同时也存在诸多问题。分析了听证制度的重大价值,对现实操作中背离其价值初衷的种种做法提出了改革意见。

With the development of China＇ s political reform, there is an increasingly urgent demand for democratic and scientific administration. Hearing system, as the core of administrative procedural law, has played a very important part in guaranteeing the equity of policy and the interests of the public. Meanwhile many problems have arisen from the system. The paper analyses its significant advantages and puts forwards some proposals for its reform in the hope of perfecting it.
