Since the reform and open policy, China socialist legal system has gradually consummated, but some flaws exists in laws： 1. the duty stipulates are more than right stipulation; 2. The body content is heavy making and the legislation expression technology is despised; 3. the expression is not clear; 4. The legislation indicates the improper word usage. How to achieves the human nature legislation and the legislation language optimization？ 1. to set up the idea of human nature legislation; 2. to overcome heavy body content, but ignore legislative expression technology thought tendency; 3. we must take seriously opposition law language research; 4. In legislation process jurist and linguistics＇ opinion must be followed.
