摘要
期待可能性理论的条件包括事实要件和价值要件。前者由客观要素和心理要素构成;行为客观情状的非常性,行为动机形成的受涉性。后者是指行为在刑法上的可宽宥性。必须同时具备事实要件和价值要件,才能成立期待可能性的弱失。本文由一个案例出发,结合期待可能性适用要件,对案件行为性质的认定进行探讨。
Application condition of expectant possibility theory is including factual condition and value condition.The former is made up of the objective factor and the psychological factor,the latter is made up of the factual condition and the value condition.
