摘要
企业制定内部适用的规章制度是法律赋予的一项重要权利,是组织生产经营、进行有效劳动管理的重要手段。企业规章制定应遵循内容合法、职工民主参与、公示及政府主管部门监督等程序。企业规章与劳动基准法律、劳动合同、集体合同在调整劳动关系方面各有侧重,我国应完善企业规章立法,共同构成协调、稳定劳动关系的完整的法律体系。
Law endows enterprises with an important right to establish their own rules and regulations,which is a significant method to organize business production and to manage business effectively.The establishment of rules and regulations should follow such procedures as legal content,the participation of the employees,public announcement and the supervision of the administrative department in charge.The rules and regulations of enterprises emphasize differently in basic labor law,labor contract and collective contract to regulate labor relations.China should perfect lawmaking of rules and regulations inside enterprises and form a complete legal system with harmoniouds and stablelabor relations.
