从中国诉讼成本高、周期长、效率低、程序复杂、不确定因素多等诉讼手段缺陷出发,提出建立有中国特色的民间调解———一仲裁调解———庭外和解替代性解次纠纷机制,缓和和调解社会纠纷与矛盾,保障社会和谐发展。

In this article, it started from the shortcomings of the lawsuit such as expensive cost long period, low efficient and complex procedure. Then an alternative system of characteristic in China resolves the dispute which includes conciliation and mediation within arbitrate proceedings and extrajudicial conciliation was put forward to alleviate the dispute and contradiction so that make the society develop harmoniously.
