投资鼓励措施在各国外资法中合法存在,极少有法律对其直接约束,但它对现行国际投资的流向、内外资平等待遇的要求是产生了消极影响的,目前已经引起了国际社会的广泛关注,中国未来立法也必将对其进行规制。

Investment incentive, mostly beyond direct restriction by law, has long been legally existing in foreign investment legislation of all countries. However, it brings about great negative effects to the tendency of current international investment and the requirement of equal treatment on domestic and foreign investment, which attracts wide attention from international society nowadays, and China will give proper stipulation and restriction on it in the future.
