无讼是中国传统法律文化的主导的价值取向。无讼价值观有其深刻的思想文化根源和经济社会政治基础。无讼的法律文化意识使我国传统法律体系不健全,阻碍法律自身的发展,影响了法律的权威和地位,成为法律文化现代化的阻碍因素,因此必须通过培育公民的权利意识,树立公民法律信仰等方式和途径实现传统法律文化的现代化转换。

Non-litigating is the primary value of traditional Chinese legal culture. It depressed individual right, despised procedure and affected the law＇s authority and position, which had became the baffling factor of modernization of law culture. For this reason we must develop the market economy, set up the citizen society, enhance the legal system education to foster the citizen＇ s law belief so as to achieve the conversion from traditional legal culture to a modern one.
