当前我国征地与拆迁过程中出现的问题应归因于公权力的不规范行使,基于其制度和观念根源,我国应该在对公权进行规制的基础上,建立以公权为主导的公权与私权平衡的体系。

The problems on the expropriation of field and remove of a building attribute to the nonstandard function of power. Based on the foundation, head of institution and concept, we should restrict power and constitute a system which keep power and right＇s in a balance.
