摘要
回顾西方自然法发展的历史过程,探讨了自然法在不同时期的话语模式及社会功用。在此基础上,文章明确提出,为建立和谐的社会,必须本着“多元共存”的态度理性对待传统文化与西式法律,追求法律与社会其他规范价值的一体化。同时,坚持司法的程序独立,实现和谐的法治。
This article presents the history,the function and the pattern of discourse of natural law,and some noticeable problems on the work of the legal construction in our country are also discussed.
