摘要
我国颁布的多部教育法律法规都明确规定,禁止教师体罚和变相体罚学生,但在教育理论和实践中,对什么是体罚和变相体罚,一直存在模糊的认识,从而导致部分教师仍继续犯体罚学生的错误,而另一部分教师又不敢大胆地管学生,甚至放任学生,降低自己工作的责任心。所以,必须明确处罚、体罚、直接体罚、间接体罚(变相体罚)以及侮辱学生人格的处罚等概念的内涵及其相互关系,同时,还必须明确,禁止教师体罚学生是教育发展和人类进步的要求,以杜绝中小学教师的体罚行为。
It is clearly defined in many Chinese educational law and regulations that teachers' corporal punishment and corporal punishment in disguised form on the students are forbidden. However, in educational theory and practice, there have been some vague ideas about corporal punishment and corporal punishment in disguised form which lead to the fact that some teachers are still making the mistakes of corporal punishment on the students, while some other teachers are not audacious to discipline the students, even take a laissez-faire attitude to the students lowering the teachers' sense of responsibility. So, it is a necessity to clarify and define the connotation of the concept and the mutual relations of punishment, corporal punishment, direct corporal punishment, indirect corporal punishment (corporal punishment in disguised form) and the punishment of humiliating students' dignity. At the same time, it should be defined that it is the requirment of education development and human progress to prohibit teachers' corporal punishment on the students, which should be observed by all the teachers conscientiously.
