国际经济一体化视野中的法律规则趋同化现象反思

Reconsideration about the Similarity of Legal Rules under the Trend of Economic Globalization

与国际经济一体化进程相伴随的是法律规则的趋同化。规则作为一种资源与效益的调节器在一方面造就一种稳定的、国际社会发展所必需的秩序的同时,也在一定程度上改变了国际法在传统上所固有的软法与弱法的形象。然而,在另一方面规则的借鉴与移植也导致了技术性的壁垒,或者说相对先进法则与本土资源不衔接的现象。同时,体现西方法律文明的规则趋同化也一定程度上侵蚀了欠发达国家的立法权。因此,对法律规则趋同化反思具有务实性与紧迫性。

The trend of consistency goes with the economic globalization. As a regulator of resources and efficacy rules produce a kind of stable order needed by the development of international society. On the other hand, they have also changed the intrinsic image of weak law of international law. However, the transplanted or referred rules also bring about technique barriers. At the same time, the trend of consistency that signifies western culture in some degree erodes the right of legalization of less-developed countries. Therefore, it is of great urgency and practical significance to reconsider the trend of consistency of legal rules.
