试论公司法应体现的社会正义理念

ON THE CONCEPT OF FAIRNESS AND JUSTICE THAT THE LAW OF CORPORATION SHOULD EMBODY

公平正义问题是人类社会的基本问题。国家和法律的基本任务就是实现社会的公平正义,保证人民的生活幸福。公司法是规范市场主体的法律,它的基本价值就是维护市场主体之间的自由公平的竞争,这样的公司法有利于市场经济的健康发展,有利于社会主义民主政治的健康发展。

Fairness and justice is the basic concept of the human society, insuring the people＇s happy life. The law of corporation is the law to set standards for the market entities, which basic value is to maintain the free and fair competition among the market entities. However, the law of corporation in our country goes against the principle in some aspects, thereafter we should reform these aspects until it can benefit the society for the healthy development of the market economy, and embody the concept of fairness and justice.
