学校体育是教育的一个重要组成部分,是促进学生身心健康的基本途径,参加体育活动是学生的基本权利。通过对涉及在校学生体育权利方面的法律法规研究对学校体育侵权行为进行界定,提出了构成这一侵权行为的四个要件。并且通过调查现阶段出现学校体育侵权行为的种种表现,对其归类,为以后制定相关法律法规,完善学校体育制度,保障学生合法的体育权益提供理论参考。

Physical education is a very important part of education. It is a basic way to keep the students in sound physical and mental health. Each student has the basic right to participate in school sports activities, Through careful research on laws and regulations on students＇ PE fights, this article gives a definition for actions of violating students＇ PE rights and puts forward four elements constituting the violation of students＇ PE fights. It also provides some theories the the making of related laws and regulations , perfection of school physical education system, and guarantee of the legal sports rights and benefits for the students after investigating all kinds of violation of students＇ physical dducation rights and classifying them.
