On the Role of Government and the Legal System in China's City Resettlement

由于城市拆迁方式的粗暴,政府角色的错位,法制的不完善,引发越来越多的社会问题。因此,法律在调整拆迁过程中的利益关系时必须坚持公权力行使必须遵循法定前提和正当程序的原则,切实保护被拆迁人的合法利益和优先保护公共利益的原则。必须认真分析政府应扮演的几个主要角色和行为要旨,使相关法制建设更加精细化,只有这样城市化才能顺利进行。

In the course of city resettlement, various social problems have arisen owing to the rude ways of resettlement, the displacement of government＇s role and the insufficient legal system. Therefore, the principle that government should conform of law when implementing its regulating rights must be strengthened. What roles that the government needs to play should be careful analyzed first. Only in this way, can the legal system for city resettlement be smoother.
