规范我国集合资金信托业务,应从法律制度设计入手,对运作模式、当事人权利义务、信息披露等进行规定。重点要解决以下问题:建立合理的运作模式;完善法律制度设计;建立制约性的监督管理体系,并分类实行差异化管理;逐步引入托管机制。

The standardization in China＇s mass capital trust transactions should start with the institutional designing in laws to stipulate the operational pattern, the rights and obligations of the parties involved, the information disclosure, etc. The stress should be put on the solutions to the following issues： to establish a reasonable operational pattern, to improve institutional designing in laws, to set up a restrictive supervision and management system and implement assorted and differentiated management and to introduce gradually the trusteeship mechanism.
