摘要
当前行业协会在我国的兴起与发展已成必然趋势,而对行业协会的理论研究与法律规制则显得相对薄弱。研究行业协会以及建立行业协会的相关法律制度必须解决3个重要问题:如何建立独立自治的、具有民间性的行业协会;如何建立国家对行业协会的合法性监督机制;如何建立行业协会与国家之间的良性互动机制,使国家、社会及私人利益得到平衡发展。
It has been an inevitable trend for trade associations to rise and develop, but the theoretical research and legal regulations on them seam respectively weaker. To study this phenomenon and establish related legal system, it is imperative to solve three important problems： how to set up independent and autonomous trade associations with a non-governmental nature; how for the state to establish a mechanism of legitimate supervision over these associations and how to bring about a benign mechanism of interaction between these association and the state so as to effect a well-balanced development between the interests of the state, society and individuals.
