浅议国际贸易中的EDI书面形式问题

自上个世纪60年代起,ED I(电子数据交换)形式在国际贸易各个方面得到广泛应用,但由于ED I所独具的新颖性,使得其与传统国际贸易法出现不相容。在传统国际贸易法中,几乎所有国家的国内立法和国际条约都对交易行为规定有书面形式的要求,但在ED I进行交易活动时,贸易伙伴的交换条款储存于计算机或仅仅显示在计算机屏幕上,并不存在任何传统意义上的书面形式。因此,传统法律中对于书面形式的要求成为推广ED I时所需要解决的首要问题之一。

Since the 1960s, the EDI（ electronic date interchange） has been taken seriously and widely in the international trade. However, EDI has its specialty. In the traditional international trade law, most countries request ＇written＇paper, but in the EDI way, there is no written paper because all information is stored in the computers or displayed on the screens, so, how to harmonize the law and the practice is the first problem which needs to be solved in the process of popularizing the EDI.
