试论完善违宪审查制度的必要性

ON NECESSITY OF PERFECTING THE EXAMINATION SYSTEM FOR VIOLATING THE CONSTITUTION

我国1982年宪法已经就宪法监督制度做了规定,但时至今日,宪法监督的理论和实践仍存在不足,违宪事件时有发生,存在极大的危害性。加之目前已有的宪法监督体制不能有效保障宪法实施,因此,完善违宪审查制度的必要性便凸现出来。

The Chinese constitution of 1982 stipulated the supervision system with regard to the constitution. However, so far there have been inadequacy both in theory and in practice. As a result, the accidents violating the constitution take place now and then, harmfullness existing. In addition, the existing supervision system with regard to the constitution could hardly effectively guarantee the application of the constitution, so the necessity of perfecting the examination system of violating the constituion appear before our eyes.
