环境 安全 健康——浅论企业职工环境权的保护

环境权作为一项基本人权,已经为世人所认同。而职工作为一个特殊的群体,在环境权的保护方面又有其特殊性。虽然我国在立法中已经体现了对环境权尤其是职工环境权的保护,但是无论是法律法规本身还是具体的落实情况,都不令人满意。应通过宪法确立我国公民的环境权利,发挥工会及各方面的作用,加强企业对职工环境权利的保护力度,并且强化职工的知情权、参与权等相关权利,使企业职工在更安全健康的环境中工作。

The environmental right as one of the basic human fights has been recognized by common people. But the workers and staff members as a special group have its specialty in the field of environmental protection. Although our legislation has reflected the protection of environmental fight, espeeially for the workers and staff members, there are some issues of law and regulations and concrete enforcement of this fight. We should establish our citizen＇ s environmental fight through the Constitution of the PRC, give full play to trade unions and other parties role, strengthen to proactive forces in enterprises for the environmental right of the workers and staff members, intensify the rights of knowing facts and participation for the workers and staff members in order to let them work in a more safety and health environment.
