针对中国在物权法中是否承认物权行为的激烈争论,文章提出“到底什么是物权行为?”“它在立法中的出现是立法者的选择吗?”等问题,并期望通过从不同层面去剖析物权行为的含义和寻找它在立法中的位置,从而来获得一个解答。

This paper reveals a number of questions, such as, what is indeed numerus conduct, and if it will be the option of legislators, based on the hot dispute whether it will be accepted in China＇s real rights law, and expects to gain a solution through exploring its connotation and its position in legislation.
