软法的兴起与软法之治

现代社会,软法在人们生活的各个领域大量出现,并呈现不断发展、增长的势头,其对公民、法人和其他组织的权利、自由产生了越来越重大的影响。软法在规范人们行为和调整社会关系方面,既有积极的作用,也有消极的作用。人们要抑制其消极作用,充分发挥和利用其积极作用,就必须通过硬法对软法的创制和实施进行规范;保障社会共同体成员对软法创制和实施过程的广泛和直接参与;保证国家和社会对软法创制和实施过程的全面和有效监督。

Soft law appears on a large scale in every field in the modem society, developing, increasing and producing a deep effect on the rights and liberties of citizens, corporations and other organizations. In the process of regulating individual activities and adjusting social relations, soft law has the negative effects as well as the positives. In order to control its negative effects and make full use of its positive effects, people should regulate the enaclment and the implementation of soft law through hard law; safeguard community members＇ abroad and direct participation in the process of the enactment and the implementation of soft law; assure that the state and the society supervise the process of the enactment and the implementation of soft law completely and availably.
