The contemporary intellectual property right institution is based on the foundation of property right or private right and the ＂Universal Declaration of Human Rights ＂has incorporated human right issue into the intellectual property right institution. An apprpriate undertanding on the private property and human right nature of the intellectual property law may optimize the global intellectual property institution or prevent the abusing activity of the intellectual property proprietor on the foundation of taking care of both individual benefit as well as public welfare.
