談權利要求中的“必要技術特徵”

On ＂Essential Technical Feature＂ in Claims

专利申请文件中，权利要求书是一份最为重要的法律文件。在撰写权利要求书时，我们往往要字斟句酌。尤其在撰写独立权利要求时，需要对写入其中的每一个技术特徵作认真节选。如果将一些不必要的技术特徵写入权利要求中，势必会导致其保护范围的缩小，给专利权人带来损失；

In a patent application document, the claims are legally most important. When drafting them, we often pick our words and sentence patterns with great caution. Particularly, we need to carefully choose each technical features to be incorporated in the claims when drafting the independent claim, Incorporation of some unnecessary technical features in the claims would inevitably result in narrowed extent of protection, causing losses to the patentee. Conversely, missing of some important technical features in a claim （＂essential technical features＇） would likely render the claim incapable of ＂resolving the technical problem＂, and, thus, contrary to the relevant provision of the Patent Law and its Implementing Regulations. Relatively speaking, the latter will lead to more serious legal consequence： rendering the claim invalid, or even causing the loss of the whole patent right.
