预防犯罪应当注意对个人自由权利的保护

西方犯罪学三大流派有一个共同点,就是在其预防犯罪的理论中都特别强调对个人自由权利的保护。这是因为犯罪是一种正常的社会现象,自由是人的一种基本权利,尊重个人自由之权利是社会文明的内在要求。在预防犯罪工作中强调对个人自由权利的保护的意义在于:它有助于人们正确认识刑罚之目的,走出刑罚万能的误区;有助于我们制订和执行合理的刑事政策,防止决策和行为方式上的失误;有助于罪犯的权利保护,使之顺利复归于社会。

A common view shared by the three main schools of western criminological theorists casts special emphasis on protection of individual right of liberty. Occurrence of crimes is not an abnormal social phenomenon. Liberty is a basic human right. Respecting individual right of liberty is an inherent requirement of social civilization. In preventing crimes, the significance of stressing individual fight of liberty is as follows ： it is conducive to understanding the purpose of penalty and getting rid of the long-standing mistaken idea that penalty is omnipotent; it is conducive to making and carrying out criminal policies and avoiding mistakes in policy-making and behaviors; and it is conducive to protecting offenders＇ rights and their rehabilitation.
