On Investigation into Public Security Cases——Study on Public Security Management Punishment Procedure Ⅲ

公安机关受理治安案件后,调查取证的过程、顺序、方法和步骤是否符合法律程序,是公安机关对违反治安管理行为人实施处罚正确与否的关键环节。治安案件调查必须坚持实事求是、依法办事的科学态度,全面、及时、合法、客观、公正地收集、调取、审查、核实有关证据,履行法律手续,为准确认定案件性质,依法追究违反治安管理行为人的法律责任,作出治安管理处罚决定奠定良好的基础。

After public security organs receive public security cases,whether the process,the sequence, the methods and the steps of evidence collection accord with the legal process or not is the key to whether the public security organs carry out punishment to perpetrator who violates the security management is correct or not. Security investigation must adhere to the principle of seeking truth from facts and law-based scientific approach. Collecting, retrievaling, reviewing and verifying the evidences cornprehensively, timely, legally,objectively and impartially to fulfill legal means lay a good foundation to accuratdy identify the nature of the case and punish the perpetrators who violate security administration.
