摘要
探索中国快速城市化和市场化改革中,城市土地供给的新产权体系。改革思路是以现行土地所有权和土地使用权两权分离为制度框架,以强化和完善土地使用权权能为核心,以土地公有私用、保护私用为重点,以有利于城市管理和房地产市场发展为目标,通过增设城市地上权、城市地役权和土地发展权,构建城市土地使用权为核心的新土地产权体系.同时,还必须与土地供给管理体制改革相互配套。城市土地供给的产权重构,是城市土地供给管理由单一行政手段向行政、经济、法律手段并用的法律基础,它更适应中国当前社会经济发展的需要。
the paper is to explore new property rights system of urban land supply with fast urbanization and marketability reform in China. The results shows that the access of the reform is to rebuild the property rights system by adding ground right and land enslaving right and land development right for urban, in which the aim is to improve the tenure and management of urban development, and emphasize the privatization of urban land. Meanwhile, it is also important to combine reforms of both regulations and administration systems with the property rights system. The paper finally points out that rebuilding the property rights system for urban is legal base to transfer administration of urban land from only administrative permit into multiple methods employing administrative, economic and legal, which is more suitable with the China' s development.
