我国妇女人权保障的宪法之维

On the Constitutional Protection of Women's Rights in China

妇女作为人权的应然主体,理应享有同等的权利保障。然而,妇女在政治、经济、文化、婚姻家庭中一直面临着普遍的歧视。为保障妇女权利的实现,必须要回归妇女作为人享有人权主体的地位。同时,需要在宪法中平等赋予和保障妇女的各项权利,并以宪法价值和精神来构建妇女人权保障的法律体系。

Women deserve the equal level of civil right protection as legal subjects of human rights. However, they are often confronted with the discrimination within the aspects of politics, economy, culture and families. To protect their rights, their status as common people who enjoy civil rights should be resumed. Moreover, all kinds of equal rights for women should be constitutionally adopted, and the whole system of women＇ s rights protection should be set up by means of constitutional right and spirit.
