关于共产主义社会有无宪法的讨论

The Discussion about Whether There is Constitution in Communist Society or Not

在什么角度和层面讨论共产主义社会有无宪法的问题是一个关系到宪法本质的问题,如果只站在阶级分析的层面来揭示宪法进而推论共产主义社会有宪法,显然是自相矛盾的,是没有其理论基础的;而如果对宪法从其目的和目标层次上进行分析,就会发现,宪法作为限制政府权力、保障公民权利、规范政府职能和组织的根本组织大法,在共产主义社会也是有其存在的基础和必要的。由此引发了我们对宪法本质的思考。

From what angle and which aspect should we discuss whether there is constitution in communist society or not is an issue that is related with the essence of constitution. If we are to reveal constitution from the aspect of class analysis and then deduce that there is constitution in communist society, it is obviously self-contradictory and groundless in terms of theory;but if we are to analyze constitution from the aspect of its aim and target, we will find that there is still the basis and necessity to keep constitution since it is the law to restrict government power,guarantee civil fights and regulate function and organization of government. All this arouses our considerations about the essence of constitution.
