农用地产权制度改革探析

A Probe into the Reform of Property Rights System of Farmland

分析我国现行农用地所有权和使用权现状,认为我国目前的农用地制度存在所有权主体不明、土地产权缺乏保护、没有合理的土地产权流转机制等方面的缺陷,已经不适应社会主义市场经济发展的客观要求,不能适应发展现代化农业和农村非农化对土地产权制度所提出的要求。有针对性地提出改革我国农地产权制度、明确界定农地产权主体、大力推进农地使用权合理流转的建议。

By analyzing farmland property rights and the present situation of implementing them, the present paper finds that China＇ s farmland property rights system has some drawbacks： subject of ownership is not clearly defined; farmland property rights are not sufficiently protected; there is not a mechanism to guarantee the lawful transfer of farmland. Due to these problems, China＇ s farmland property rights system proves incapable of meeting the requests of developing socialist market economy and modern agriculture. Moreover, it turns out to be ineffective in settling problems caused by the urbanization of rural areas. On the basis of the above analysis, the paper finally points out that China＇s farmland property rights system must be reformed; in particular, the subject of farmland ownership must be clearly and precisely defined and the reasonable and lawful transfer of farmland should be encouraged.
