The Mechanism of Legal Regulation of Circular Economy

法律调整执制是从整体、动态的角度来研究法律制度,在人类社会不同的发展模式下,法律调整机制存在着显著的差异。循环经济是促进社会、经济与生态环保协调统一的“三赢”经济发展模式、研究循环经济法律调整机制有利于从动态的角度系统地把握和理解调整循环经济的各种法律手段,指导循环经济立法。在循环经济发展过程中,应结合政府、市场、社会等各方面的力量,对与经济发展密切相关的各种利益关系进行系统调整,综合运用行政强制、行政指导、经济刺激和公众参与等各种不同的法律手段,逐步形成规范而有序的法律调整机制。

The circular economy is a new economic development mode which promotes the integration of society, economy and environment. Various benefit relations are existed in its developing process. The mechanism of legal regulation is a system which develops and makes use of various legal measures to form a comprehensive and dynamic perspective in order to balance complex benefits. Along with the changes of the economic development mode, the mechanism of legal regulation is also changing. To study the mechanism of legal regulation of circular economy is beneficial for grasping and understanding various legal measures and for guiding the legislation of circular economy. In the process of developing circular economy, we should combine the power of government, market and society, regulate various relations within the economic development, utilize various legal measures of compulsory administration, administration guide, economic stimulation and public participation to establish a standard mechanism of legal regulation.
