试论打击国际恐怖主义中的国家自卫权

State Right of Self-defense in Fighting against International Terrorism

国际恐怖主义是一种严重危害国际和平与安全的国际罪行,国际社会必须通力合作予以严厉打击。打击国际恐怖主义往往使用武力。按照现行国际法,国家在行使自卫权时可以使用武力。本文拟对武力反恐中的国家自卫权的含义、适用以及由此引发的国际法上的问题进行分析论证并对未来作出展望。

International terrorism is a severe international crime against the world peace and security. And a severe fight against it should be given by the whole world. The fight is usually started with force, which according to the existing international laws, is allowed to be used when some certain country implements its right of self-defense. This article aims at the analysis and argument of the indications of the right and its application as well as its prospect.
