我国私人侦探法律制度的构建刍议

On the Establishment of Private Detective Legal System in China

私人侦探在我国大量存在且无序发展,由于相关的法律制度缺位,导致与此相关的问题和争议颇多。我国有必要尽快建立一套行之有效的私人侦探法律制度,以满足巨大的社会需求、弥补公力救济不足、提高司法效率、促进诉讼实务发展以及增强私人侦探行业的国际竞争力。同时,由于物质基础已具备、法制条件已成熟、公众思想条件已成就,建立我国的私人侦探法律制度也是可行的。在良好的制度保障和约束下,私人侦探必将健康发展,发挥其积极作用。

Nowdays there are a large number of private detectives in China. Owing to the lack of legal restriction, relevant social problems and disputes arise. It is necessary to set up Chinese private detective legal system in order to satisfy social demands, supply the deficiency of judicial remedy, improve judicial efficiency, and enhance international competition. Furthermore, it is feasible to set up China＇s private detective legal system because of the sufficient economic conditions, jural conditions and ideaistic conditions. With restriction of this legal system, private detectives will develop properly and take positive effect.
